Daniel Balys is an attorney in Croke Fairchild’s Real Estate Practice.

Daniel represents developers and investors in all aspects of real estate development projects and represents purchasers and sellers in many types of commercial real estate acquisitions and dispositions, for properties including industrial, office, retail, multi-family, hospitality, data centers, renewable energy facilities, and other commercial properties.

With significant experience representing investment and commercial banks and other financial institutions, Daniel advises clients on loan originations, loan workouts and restructurings, and note sale transactions that are secured by commercial real estate assets of all kinds, including office buildings, retail properties, hotels, industrial properties, and multi-family properties. He has represented lenders in the origination of portfolio loans and loans originated for commercial mortgage-backed securitization programs.

Daniel’s lending practice includes construction, purchase, refinancing, and restructuring. He has represented a variety of financial institutions at the senior loan, junior loan, and mezzanine loan levels and in the capacities of administrative agent, co-lender, and lead lender.

Overseeing and counseling clients on litigation, arbitration, dispute resolution, and mediation matters related to real estate or construction, Daniel coordinates with local counsel to interface with state and local municipalities, boards, regulators, and departments regarding zoning and use requirements for land development.

In his work across a wide array of real estate projects, Daniel drafts and negotiates purchase and sale agreements; property management, asset management and other management agreements; corporate operating agreements of all kinds; leases of all kinds, representing both landlords and tenants; construction, engineering, and architect contracts; vendor/supplier contracts; telecommunication agreements; and other operations-related documents.

Prior to transitioning to private practice, Daniel was in-house counsel with Equity Office Properties Trust (the largest publicly traded REIT with over $25 billion dollars in real estate holdings) and oversaw the company’s acquisition, disposition, financing, and leasing of office buildings.
