Jim Kunick has over 25 years of experience representing both customers and providers in a broad array of complex commercial, aviation, IP, telecommunications and technology transactions. With a background in Industrial and Systems Engineering, Jim is also a registered patent attorney.

Jim advises clients on telecom and network services agreements, data licenses and data analytics agreements, data center colocation agreements, open source software licensing, IT and business process outsourcing, SaaS, DBaaS, hosting and related cloud services agreements, software and technology licensing transactions, the IP-related aspects of mergers and acquisitions, and other commercial relationships including alliance, manufacturing, marketing, and supply agreements.

Jim previously served as Assistant General Counsel of Capgemini where he was responsible for leading the negotiations of complex transactions involving the company’s provision of applications development and maintenance (ADM) and business process and IT managed services, software implementation and systems integration services, corporate acquisitions and numerous ancillary agreements. Jim also served as outside general counsel for an international provider of medication adherence packaging systems and a leading Sales Force eCommerce solution provider.

Notable transactions on which Jim has advised include:

  • Leading the negotiations of data center colocation agreements for a multi-national organization providing the world’s highest density data centers designed to minimize AI’s high energy costs.
  • Leading the negotiations of SaaS-based online ticketing and distribution agreements for several international airlines with Expedia and Accelya (Farelogix).
  • Representing a leading technology service provider enabling uniform PostgreSQL (Postgres) services from self-managed to fully managed DBaaS in the cloud in their DBaaS subscription, license, support and professional services agreements with customers.
  • Serving as US counsel to a European-based IT service provider in the global hospitality industry in its negotiation of an IT outsourcing agreement with an international airline.
  • Serving as outside general counsel for a leading eCommerce solution provider in transactions for its enterprise eCommerce application developed natively on the Salesforce Platform, and professional services agreements for implementation and support.
  • Leading the negotiations of data center colocation and cloud services agreements with global travel technology companies, and call center outsourcing agreements, for an international hotel franchisor.
  • Serving as outside general counsel for an international provider of medication adherence packaging systems and leading the negotiations of its license and services agreements for robotics and packing technology designed to improve medication dispensing and administration.
